Too bad that nobody's been able to respond to this, since I have a similar issue. Unfortunately Adobe does not state which of its encoders / exporters does color scaling/clamping.

However, to address your second concern: Encore will not touch your files if you present it DVD-MP2 compliant streams. Inside the project window those would be listed as "Don't Transcode".
